Anwar Ibrahim Posted: 10 Apr 2012 07:16 PM PDT Repeal of ISA is Commendable, But Provisions in New Law That Depart From Ordinary Principles Must be Reviewed Posted: 10 Apr 2012 04:16 AM PDT The Malaysian Bar commends the Honourable Prime Minister for fulfilling the promise he made on 15 September 2011 to abolish the Internal Security Act 1960 ("ISA"). Since its enactment more than fifty-one years ago, this piece of oppressive legislation enabling preventive detention without trial has been extensively condemned for being a gross violation of human rights, and for the cruel and indiscriminate abuse resulting from its use. The Malaysian Bar is fully supportive of the Government's aim to combat terrorism, which represents an extraordinary threat to international and domestic peace and security. The Government's counter-terrorism policy and actions must strike a delicate balance between collective security and individual liberties, and be consistent with the rule of law. In its Memorandum dated 19 July 2010 ("Memorandum")[i], the Malaysian Bar expressed its view that there is adequate legislation to combat terrorism and, where necessary, the existing legislation could be strengthened alongside improved safeguards and oversight mechanisms. Nonetheless, the Bar acknowledges that the replacement legislation — the Security Offences (Special Measures) Bill 2012 ("Bill") — and the amendments to the Penal Code, Evidence Act 1950 and Criminal Procedure Code ("Amendments") allow for the right to trial, and contain some provisions found in the laws of other jurisdictions[ii]. Furthermore, the maximum period of detention of twenty-eight days, after the arrest and detention period of twenty-four hours, is consistent with the Bar's position in its Memorandum. Bar Council was invited by the Honourable Attorney General to provide its comments — although within a short period of time prior to this legislation being tabled in Parliament — and two meetings were held to discuss the Bill. We welcome the open-minded and frank dialogue with the Attorney General's Chambers, and note that some of our suggestions were accepted. Whilst we appreciate the Government's desire for quick action and the hard work of the Attorney General's Chambers in its study, and drafting, of the Bill and the Amendments, we urge that in future the consultation process be more extensive, and more time be provided for it. The Bill vests extraordinary and wide-ranging powers in the Government. The Bar expresses its concerns regarding, inter alia, the following issues[iii], which deserve further study and debate. (a) Preamble — the validity of the Bill is not dependent on the invocation of Article 149 so long as it contains safeguards consistent with fundamental liberties. (b) Section 3 (Interpretation) — the definition of "security offences" includes an act that is prejudicial to national security or public safety.[iv] Such a definition is too wide. Instead, a more precise, and better, definition can be found in the United Nations Convention for the Suppression of the Financing of Terrorism: Any act intended to cause death or serious bodily injury to a civilian, or to any other person not taking an active part in the hostilities in a situation of armed conflict, when the purpose of such act, by its nature or context, is to intimidate a population, or to compel a government or an international organization to do or abstain from doing an act. (c) Section 4 (Power of arrest and detention) — the extension of the period of detention for a duration of not more than twenty-eight days should be subject to judicial oversight, instead of by way of decision of a police officer of or above the rank of Superintendent. (d) Section 6 (Power to intercept communication) — this power should be exercised by a judge, and solicitor-client communications must be protected. (e) Parts IV (Special Procedures Relating to Sensitive Information) and VII (Evidence) — it is here that the Malaysian Bar has its greatest concerns, and where there are radical departures from the current rules of evidence. The use of a summary of the evidence (as opposed to the evidence itself) and the lowering of the admissibility threshold will pose a serious impediment to a fair trial. In particular, the radical departure from the ordinary rules of evidence may negatively impact on the accused's right to a fair trial. Counter-terrorism laws, policies and decisions must not usurp the very rights and freedoms that the terrorists themselves are threating. We appreciate the assurance of the Attorney General that there will be continuous study and review of the Bill and the Amendments, and that the Malaysian Bar's contribution will be welcomed. Apart from the ISA, the other legislation that now remains for the Honourable Prime Minister to consider amending — to rid our statute books of all arbitrary detention laws — are the Dangerous Drugs (Special Preventive Measures) Act 1985 and Prevention of Crime Act 1959, on the assumption that there will be no re-introduction of the Emergency (Public Order and Prevention of Crime) Ordinance 1969. The Malaysian Bar encourages and supports the Prime Minister to continue on a path of law reform that is consonant with international human rights norms. Lim Chee Wee President Malaysian Bar 10 April 2012 | Altantuya Came to Malaysia to Meet Najib, Claims Her Father Posted: 10 Apr 2012 02:07 AM PDT The Malaysian Insider Murdered Mongolian Altantuya Shaariibuu came to work in Malaysia to specifically meet Datuk Seri Najib Razak, her father has alleged. Dr Setev Shaariibuu said today that when he asked his daughter a few years back the purpose of her trip to Malaysia, she said she had to "meet important people." "I asked her what was her purpose of travelling to Malaysia. She showed me a picture… taken in Paris. Three people were in it — Abdul Razak Baginda, Najib, and Altantuya. "She said 'I have to meet important people', and pointed to Najib," he told reporters, through Mongolian interpreter Tsoggerel Och. Shaariibuu (picture) said he did not know who Najib was when he saw the photograph several years back. "She told me she had something to decide with Najib. I told her it was not worth it but she went anyway. "A lot of witnesses have seen this picture," said a visibly-tired looking Shaariibuu. The father of the murdered Mongolian woman has offered himself as a witness to the on-going Scorpene submarine sale probe by French authorities, claiming his daughter's death was linked to the case. Shaariibuu said today his testimony would be able to "connect the dots" between her death and the Scorpene case, and that he will say "what he knows at the right time." "She went to Malaysia against my will," he said softly. Altantuya's one-time lover Abdul Razak, who was a close associate of Najib, was acquitted of a charge of abetting two Special Action Squad members — Azilah Hadri and Sirul Azhar Umar — to commit the murder in 2006. The murder was committed between 10pm on October 19, 2006, and 1am the following day at a clearing in Shah Alam's Mukim Bukit Raja. While Abdul Razak was acquitted, his co-accused Azilah and Sirul were found guilty and sentenced to death. Setev has also filed a RM100 million civil suit against the government and the convicted duo in June 2007, seeking compensation for the hardships his spouse and two grandchildren have suffered because of Altantuya's death.

Sekali lagi calon Bebas hilang deposit.
PKR DUN 19 Kepayan P174 Penampang, Sabah. Posted: 10 Apr 2012 11:33 AM PDT PTPN will be abolished once PAKATAN RAKYAT forms the Government. Posted: 10 Apr 2012 06:52 AM PDT PKR Supreme Council Member cum PKR Sabah Secretary Dr Roland Chia urged for the abolishment of PTPN loan that is currently imposed by the present BN government to students pursuing tertiary education. Dr Roland Chia was making this call in view of numerous complaints from worrying and stressful students and parents who took the PTPTN now regret taking the loans. Firstly, they have to start paying back the PTPTN loans 6 months after graduation whether employed or not. If not they will be blacklisted and penalties will be imposed due to late payment. Whilst another group of students especially from the inner most interior region of Sabah despite having offer letters to pursue tertiary education but unable to register due to additional administration costs imposed by the educational institution and also travelling costs i.e flight costs to travel from Sabah to Kuala Lumpur. As far as PKR & Pakatan Rakyat is concern, PTPN loans will be scrapped once the Pakatan Rakyat is given the mandate to form the next federal government. In the state of Selangor the Pakatan Rakyat State Government, policy of students of Selangor birth , who has gain admission to tertiary educations locally were given a once off monetary aid of RM1000 to offset miscellaneous costs have been implemented. Every Malaysian has a right to education. Education is one of the necessities of life and nations which have developed have the best education systems are not surprisingly world leaders in almost every arena. As long as someone wants to get an education and is qualified to attend a certain course, then he or she must be given the right to pursue that knowledge. Is it fair if just because a person does not have the money, he or she is denied education while someone who is mediocre but has the money gets it? Turkey is one of the model countries in the world that provided free education from primary up to tertiary education despite being a net importer of Oil/ Crude Petroleum Oil i.e. a country that doesn't have the wealth of oil and gas. Malaysia despite being an oil rich country with PETRONAS having an annual profit of RM60 Billion cannot even provide the basic necessity of education to her citizens. In Buku Jingga Pakatan Rakyat Sabah, the state Sabah will be given greater autonomy in implementing educational policies when the Pakatan Rakyat Sabah is given the mandate to govern the state – Dr Roland Chia added.
