A court official (CJM's special officer) said those called to court to face charges are not allowed to use any entrance other than the main entrance to enter the courtroom. He said this after five policemen charged with assaulting a businessman in Kota Damansara last December caused a stir in a magistrate's court here when they entered the courtroom through the staff entrance and not through the main door. Asked how the five accused had been allowed to enter from this entrance and whether they had received preferential treatment because they were from the police, the court official said: "The policemen accused in this case were allowed to use that entrance by the police on duty at the courthouse. "The police have been warned never to do that again," he said. Irritated by their entry through the staff entrance, lawyer Lim Lip Eng, who is holding a watching brief for plaintiff Chia Buang Hing, told magistrate Nik Mohd Fadli Nik Azlan that the accused should not have used that entrance. Lim then applied to the court to order them to re-enter the court room via the main door and to leave through the same door. Nik Mohd Fadli, however, said he could not give such an order and rejected Lim's application. Four of the accused, constables Mohd Azwan Hassan, Norzali Rosle, Ahmad Saifullah Osman and Alizulhafiz Abdul Ghafar, were charged on Jan 11 with intentionally causing hurt to Chia at the Kota Damansara police station at between 12.30am and 3am on Dec 19. Mohd Azwan and Norzali (both currently suspended) were also charged with causing hurt to Chia at Jalan PJU 3/15 between 11.30pm on Dec 18 and 12.30am on Dec 19. The fifth accused, Lans Kpl Mahadi Adam claimed trial in the same court to a charge of disobeying an order under Section 20 (3) of the Police Act 1967, relating to the incident. Norzali was charged in another magistrate's court with intending to cause false charges against Chia, 35, for allegedly having drugs and a machete at the Kota Damansara police station at 2.01am on Dec 19. Norzali had, on Jan 28, pleaded not guilty to the charges. In applying for the court to disallow the five to use the staff entrance – located at the back of the courtroom – Lim had argued that all are equal before the law. "Everybody else enters the court through the main door," he said. Ricky Tan, another lawyer holding a watching brief for Chia, also argued that the court would set a precedent for others if it allowed the accused to enter via the staff door. However, counsel Ahmad Zaharil Muhaiyar, who represented the five policemen, argued that Lim had applied for the order because press photographers were outside the main entrance to take pictures of the accused. The arrests of Human Rights Party(HRP) protesting against some derogatory contents in the school text "Interlok" is regrettable and an abuse of basic human rights and freedom to protest peacefully. DAP urges the BN government to take into account the genuine concerns of Malaysians who feel insulted by derogatory descriptions in the book. Any failure to address these concerns would only show that 1Malaysia is all talk and no action. DAP opposes the arrests of HRP members and urges the BN government to drop all charges against those who want to protest peacefully. In marking World, the BN government claims that it is committed towards resolving religious issues in the country and preserving the well-being of Malaysia's multi-racial community. | Lets improve the efficiency of PTP in Johor Posted: 14 Feb 2011 12:17 AM PST DAP National Deputy Chairman and MP for Kepong Dr Tan Seng Giaw repeats his call for improving the efficiency and security of the Port of Tanjung Pelepas in Johor.
On 14.2.2011, Dr Tan responds to the PTP statement that it has stringent measures to ensure maximum security for cargo shipments. Lets hope that these measures are truly effective, making the container port more popular.
PTP is in the top 20 of the world's container ports. It can improve further. The most important thing is never to repeat the massive scandal of the Port Klang Free Zone (PKFZ).
Apparently, the port handles about 6.5 million TEUs (containers/twenty-foot equivalent units) last year. The Port of Singapore (PS) is the world's busiest port that tranships a fifth of the world's shipping containers, over 23 million TEUs. We are not saying that PTP catches up with PS as soon as possible. PTP has attracted Maersk which is the biggest container carrier in the world. Can PTP keep the company?
Besides good measures for port security, we would like to see efficiency. For instance, if a container ship arrives at PS in the morning, the containers can be taken out of the port within 24 hours. How long would it take PTP? Is it 48 hours? Can it be as long as two weeks?
I shall follow up the performance of PTP, Port Klang, Penang Port, Kuantan Port and Pasir Gudang Port. I believe that they can do much better.

| MACC Ridicules Itself Over RM6 billion OPVs Posted: 13 Feb 2011 09:04 PM PST MACC ridicules itself by claiming that it requires a report from me to commence any investigations on the Ministry of Defence RM6 billion of purchase of offshore patrol vessels.
Bernama quoted an unnamed source from the Commission claiming that "the commission cannot carry out an investigation based on wild allegations", insinuating that the issue which I had raised in the past week was completely baseless and frivolous.
The report added that "if the Petaling Jaya Utara MP did not come forward, the source said, the commission would try to get in touch with him to get "valid facts" to start sinvestigations".
I nearly choked on my breakfast reading the report, not because I fear being contacted by MACC but because the Commission has completely ridiculed itself on 2 counts.
Firstly, MACC should perhaps read both my statements, which are published on my blog on the issue. And if there's difficulty in comprehending the statement in English, then I'd be more than happy to translate it for them.
When the Defence Minister Datuk Seri Dr Zahid Hamidi announced the purchase of 6 naval patrol vessels (OPVs) for RM6 billion ringgit without accompanying details, what I asked was what exactly was the Navy acquiring in terms of the exact type of OPV.
I cited examples where lower end OPVs could be purchased at costs significantly lower such as the Irish Roisin class (US$34m) or what was recently acquired by New Zealand for NZ$90 million (RM210m). Similarly, I cited the example of the US Littoral Combat Ships (LCS) which will cost substantially more at US$300 million.
My statement did not accuse the Ministry of purchasing low-end OPVs at for RM1 billion each. My statement requested the Ministry to justify its purchase by giving detailed specifications on the type of OPVs which was being acquired since the original Minister's statement as reported also by Bernama did not carry details.
Hence the call by MACC for me to file a report with them is irrelevant and the need does not arise at this point of time.
Secondly, MACC's claim that its unable to do anything without a report from me is even more ridiculous. Should MACC require clarifications on the details and cost of the ships, they have the power to summon the relevant officials with the information, which I'm powerless to do.
As an MP, in the interest of the rakyat, I can only ask the right questions when the need arises to check on the various government agencies. Similarly, it would have been MACC's proactive responsibility to at the very least conduct preliminary inquiries on the very substantial RM6 billion OPVs purchase which didn't come with details when it was first announced, and not have to wait for an MP to raise the questions.
MACC's abdication of responsibility in cases such as this is disappointing and is clearly a factor in the decline in the Transparency International's Corruption Perception Index for Malaysia, that the Government is losing the fight against corruption.
Not every inquiry investigated will lead to a genuine abuse or corruption case. But the fact that MACC failed to even monitor developments in mega-government acquisitions in the billions of ringgit marks its failure as the agency to fight against corruption in the country.
Instead by attempting to shift its responsibility to an MP who is raising very relevant questions on the RM6 billion acquisition is makes a mockery on the commitment and competence of MACC. | |
