Stop the Impossible Task of regulating the Impossible

From a university dropout, William Henry Gates III turning lines of codes into the Windows Operating System first released back in 1985, to a Harvard social misfit, Mark Zuckerberg creating the world most successful social media site – Facebook.com, the industry is one that is fertilised by impulse and innovation, perpetually morphing and forever intruding into every aspect of our lives.

The industry is so pervasive that hardly any product escapes its reach. Computer programming is required today to build your car, produce movies and animations, set up manufacturing plants and to develop an efficient order management system to deliver pizzas. IT is the industry of making what was "impossible", possible.

The draft Computer Professionals Bill 2011 however, is an ill-conceived impossible attempt by the Government to regulate the "impossible". The proposed bill fails because the limits and scope of the law cannot be strictly defined as the industry changes by the minute.

"Computing services" for example, will include today, website designers, setting up blogs or anyone producing an animated Flash-game for your Facebook. In fact, with seamless integration of a simple word processor, such as Microsoft Word with the Internet, a desk clerk now effectively becomes a provider of "computing services".

The definition of "critical national information infrastructure" will be equally impossible define as it would and could encompass any industry from the government sector to financial services to the telecommunication communications or even the airline or transportation industry. Surely a failure in any of these industries would have a "devastating impact on national economic strength".

Putting the two indefinable terms together will result in absurd outcomes. An advertising agency offering web design services for a bank will have to become a "Registered Computing Services Provider", or a technician providing maintenance services of computer hardware in a government office would have to be registered as a "Registered Computing Professional" or a "Registered Computing Practitioner", whichever applicable.

What is unimaginable would be for Microsoft to have all its computer programmers in the United States registered with the Board of Computing Professionals in Malaysia, before the company could sell its software to entities providing "critical national information infrastructure" in the country! If Microsoft or Hewlett Packard or any other product developer or manufacturer involving "computer services" from overseas could be exempted from being "registered", then why should Malaysians be penalised for being unregistered?

The Bill and the bureaucracy to be created with its implementation will become an utter waste or resources for both the Government and the industry. Registration of practitioners or professionals does not guarantee quality and will not lift industry standards. If other countries from the United States to South Korea, from to Singapore to Germany and from India to South Africa do not require such a Bill to design, develop and produce top quality computing and related products, what makes the Government think that such a Bill will miraculously make Malaysia a top computing nation?

In fact, the implementation of such a Bill will only lead to an exodus of talent in Malaysia because they will find the environment substantially more conducive in other countries to pursue their computing dreams.

Bill Gates, Mark Zuckerberg and hundreds of others did not succeed because they registered with a "Board of Computing Professionals" in the United States or elsewhere in the world. On the contrary, their success is based precisely on an environment which encouraged unrestrained creativity, breeding innovation without the leash.

The Malaysian Government will do well to admit the mistake that is the Computing Professionals Bill, and withdraw the thought of ever tabling the bill in the Parliament.

More parking bays in SS18

SIXTY three more parking bays have been added along Jalan Ss18/1B, providing a much needed relief to residents and also shop owners along the stretch.

ADUN Subang Jaya Hannah Yeoh said the shop owners along the road had also requested for a one-way traffic system to be implemented for the two-lane stretch.

"There is a great need for parking space in SS18 especially those fronting the shop houses. My office has also received many requests from residents all over Subang Jaya for their roads to be resurfaced."

"We need more funds from the State Government in 2012 to do so," she said after inspecting the new parking bays.

Hannah said for a sum of RM1mil, MPSJ was only able to resurface approximately eight to nine kilometers of road.

"We are presently going on a road to road basis depending on the urgency of the request from residents," she said.

SS18 TJ House Restaurant owner Jeffrey Tan who was present said the extra parking bays was good as it helped ease the need for space for residents and customers who frequented the row of shop houses in the area.

"Parking space is inadequate especially during the evenings when people come over to dine at the restaurants in this area," he added.

(8) Jalan USJ 9/3F (with 18 additional newly created parking bays) and a few other streets in USJ 9
(9) Jalan TP 1/4
(10) Junction from Persiaran Tujuan heading to Persiaran Kewajipan
(11) Jalan Persiaran Subang

Bright lights, happy community

The SS15 field in Subang Jaya, the only open space for some 340 houses in the community, is now bright even at night following the installation of two floodlights.
Subang Jaya assemblywoman, Hannah Yeoh, who officiated a ceremony to commemorate the completion of the installation today, said the lights were built along with other upgrades such as a walking path, exercise stations, work stations and a fence around the football field.
The ceremony drew the participation of more than 50 residents, who donned their residents' association t-shirts and made merry while witnessing the official opening of the upgraded park.
Yeoh said the lights cost about RM9,000 and were funded by the Subang Jaya Municipal Council (MPSJ).
"This was requested by the residents as the area is a hotspot for crime," she explained.
"Following the installation of floodlights, they now have better security and are also able to use the facilities at night," she said.
Loi Kheng Min, the MPSJ councillor for JKP Zone 1 (under which the SS15 neighbourhood comes under), also noted that SS15 is one of the oldest neighbourhoods in Subang Jaya and many of its residents are retirees.
"They now have an extended time to exercise," he said, referring to the lighted park.
How the residents organised themselves
SS15 residents' association secretary, Michael Surendran, said the residents first organised themselves in a group in 2009 due to concern about the rising crime rate in the neighbourhood.
"We then decided to have our own voluntary patrols every night to fight crime," said the former police official.
He said that with Yeoh's assistance, they managed to get bicycles, vests and torchlights for the patrols.

The efforts were effective. Surendran said he once confronted a gang of burglars who were breaking into a house. He alerted the police, and the gang was busted in Cheras later.
He also said a small alley beside the field used to be a crime spot as many students and residents were using it to get to the shoplots, even during at night.
The residents then requested the authority to make it into one-way road, and Yeoh had in last year allocated a fund to build a police beat near the alley.
"Since then, the crime rate dropped by almost 100 percent," Michael said.
Yeoh commended the residents on their initiative to get together, and said it should be emulated by other communities.
"By getting together as one voice, your demands can be more clearly heard," she said.

Ucapan Perbahasan Bajet Negeri Johor 2012, Dr. `Boo Cheng Hau ADUN Skudai merangkapKetua Pembangkang DUN Johor pada 12 Disember 2011

Selamat pagi dan salam sejahtera. Saya inginmengucapkan terima kasih kepada YB Dato' Speaker kerana diberikan peluang untukberbahas berkenaan Bajet Negeri Johor 2012.

PENDAHULUAN 

YB Dato' Speaker,

Prestasi Ekonomi Negeri Johor danIskandar Malaysia

Laporan Ekonomi Negeri Johor 2009/2010 yang disediakan oleh UPEN tidakdapat  dibentangkan kepada Dewan yangmulia ini pada persidangan bajet tahun 2010  tetapidibentangkan selewat persidangan Jun tahun ini.

Oleh itu, pada persidangan bajet tahun 2010 yang lalu, Dewan ini tidakdapat memperbahaskan fakta bahawa pada tahun 2009 ekonomi Negeri Johor menguncup dengan kadar yang amat membimbangkan. KDNK per kapita Negeri Johor menuncupsebanyak -12.5%, KDNK per kapita berasaskan pariti kuasa beli  menurun sebanyak -18.0%.

Walaupun KDNK per kapita dan KDNKper kapita berasaskan pariti kuasa beli melonjak sebanyak 12.0% dan 21.2% masing-masing padatahun 2010, kelonjakan  pertumbuhan ekonomi ini disebabkan penguncupanekonomi pada tahun 2009.

Kenaikan harga minyak sebanyak 8.5%pada Julai 2008  telah mengakibatkan indeks harga pengguna melambung sebanyak 5.4% pada tahun 2008 dan 2.7% pada tahun 2009 sedangkan pendapatanindividu  dan pertumbuhan ekonomi menguncup  dan inflasi yang melambung telah  membebankan rakyat jelata.

Walaupun pertumbuhan KDNKmencatat 9.3% pada tahun 2010 dan dijangka mencatat 5.9% pada tahun 2011, indeks harga pengguna meningkat 1.7% pada tahun 2010 tetapitelah mencecah 3.4% pada Oktober tahunini dan inflasi makanan 5.7%.

Indeks Harga Pengguna atau inflasi yang melambung telah membayangkankegagalan rakyat jelata menikmaiti pertumbuhan ekonomi yang dihebah-heburkandisebabkan inflasi mencecah.

Kayakinanbisines atau Business Confidence (www.tradingeconomics.com) menurun dari 114.0 pada musim kedua kepada 104.5pada musim ketiga tahun ini ekoran  laporan bahawa indeks persepsi rasuah atau Corruption Perception Index Malaysiamenurun  tiga tahun berturut-turut.
Malaysia mendapatkan 4.3 markah tahun ini  manakala 4.4 pada thaun 2010. Kerajaaangagal memperbaiki prestasi CPI Malaysia kepada tahap 4.9. 
Meneurut CPI , Malaysia mengambil tempat ke-60di antara 183 negara dan ke-3 di antara negara-negara ASEAN slepas Singapore (CPI=9.4) dan Brunei (CPI=6.3). Tetapi prestasi CPIMalaysia begitu jauh di belakang  Singapuradan Brunei.

StrategiMemajukan Sosio-ekonomi  Malaysia danJohor

Oleh itu, demi memajukan taraf sosio-ekonomiMalaysia dan Johor, persepsi rasuahsewajarnya diperbaiki khasnya untuk meyakinkan para pelabur dan rakyat jelatabahawa Kerajaan berazam membersihkan imej negatif disebabkan masalah rasuah.
Kedua, KerajaanJohor sewajarnya memperbaiki keadaan kewangan kerajaan dengan mengurangkandefisit dan hutang kerajaan, melabur wang kerajaan secara berhemah,  mempercepatkan projek-projek pemabangunanmenurut jadual supaya meyakinkan para pelabur dan rakyat jelatadengan keberkesanan dan keazaman kerajaan untuk berubah.
Ketiga,pengurusan  dan prestasi kewangansyarikat-syarikat kerajaan perlu diperbaiki serta mempertimbangkan kemungkinan menjual syarikat-syarikat dorman ataukurang berprestasi di pasaran terbuka kepada bukan sahaja para pelaburtemapatan bahkan pelabur asing memandangkan pembanguan Iskandar Malaysia sebagaipusat pelaburan antarabangsa terbaru.

Keadaan Kewangan Kerajaan Negeri

YB Dato' Spekaer,

Saya ingin menjemput rakan-rakan se-Dewan ini supaya kita dapat berbahas secara lebih bijak secara mengasaskanperbahasan atas fakta-fakta fiskal.

YB dato Speaker,

Wang tunai rizab Kerajaan Selangordi bawah pentadbiran baru Pakatan rakyat meningkat dari RM 400 juta pada waktu pengambil alihan kerajaan pada tahun 2008 kepada RM 918 juta pada tahun   2010,. Pelaburan Kerajaan Selangormencecah RM 668 juta pada tahun2010, iaitu kumpulan wang disatukan adalah RM1,586 juta  pada tahap yang lebihtinggi daripada hutang awam sejumlahRM1,004 juta.

Di sebaliknya, walaupun amaun wang pelaburan  Kerejaaan Negeri Johor RM 467 juta padatahun 2010, malahan wang tunai rizab kerajaan Johor menurun dari 100 juta pada tahun 2007 kepada RM 38 juta pada tahun 2010.
         
Walaupun Kumpulan wang disatukan kerajaan Johor adalah sejumlah RM 505 juta, masih jauh kurangdaripada  hutang awam yang telah menignkat ke tahap lebih tinggi, iaitu RM 1,379 juta.   

YB  Dato' Speaker,

72% wang pelaburan Kerajaan Negeri Johor  (RM 311 juta) dilabur dalam saham berisikotinggi di pasaran terbuka dengan pulangan yang tidak konsisten   sedangkan pelaburan ini telahbercanggah dengan keputusan  MajlisJemaah Kerajaan Negeri pada 4 Nov 1991bahawa sekurang-kurangnya 70% wangpelaburan kerajaan negeri sewajarnya dilabur dalam bentuk saham berisiko rendah atau saham amanah.

Oleh yang demikian, YB dato' Speaker, padatahun 2010, suatu nilai sham jangkamasa panjang yang dilabur oleh kerajaannegeri telah dirosotkan nilai sepenuhnya pada kos RM 134.56 juta!   

Kerajaan Negeri sepatutnya menjalankan tugas seperti pelabur yang berwaspada semasa melaburkan wangkerajaan atas amanah rakyat  bukannyaberlagal kaki judi yang suka mengambil risiko.  
Malahan terdpapat dua syarikat kerajaan iaitu SAJ Sdn Bhd dan SyairkatPermodalan Darul Ta'zim Sdn Bhd tidakpernah memberikan sebarang pulangan kepada kerajaan negeri.


YB Dato' Speaker,


Keadaan kewangan kerajaan negeri masih perlu diperbaiki memandangklan hutang awam kerajaan negeri meningkat 8.6% dari RM 1.27 billion tahun 2009kepada RM 1.38 billiion pada tahun 2010.

Walaupun pinjaman dari kerajaannegeri kepada syarikat-syarikat kerajaan yang boleh dituntut sejumlah RM 1.26 billion baru-baru dikira sebagaiasset kerajaan, pinjaman kerajaan kepada GLC termasuk  SAJHoldlngs Sdn Bhd RM 735 juta,  SpecialWater Sdn Bhd RM 430 juta  dan J Corp RM 92 juta  sewajarnya diteliti dari segi keberkesanan GLCsupaya tidak membebankan kerajaan negeri .  

Oleh itu, Kerajaan Negeribertanguunga jawab kepada Dewan ini sama ada  pulangan yang terbaik akandikembalikan kepada kerajaan negeri selepas PAAB mengambil alih asset SAJ dananak syarikatnya.

YB Dato' Speaker,

Pengambilalihan aset SAJ Holdings Bhd oleh PAAB akanmengubahkan tafsiran Perlembagaan Persekutuan atau Kontrak Sosial di mana kuasamengurus sumber dan bekalan air akan dialih dari kerajaan negeri kepada kerajaanpersekutuan  selepas 55 tahun kemerdekaan,

YB Dato' Speaker,

Jika  pengambil alihan SAJ Holdingsoleh PAAB   akan menyelesaikan hutang SAJHoldings dan anak syarikatnya, syarikat kerajaan kurang memuaskan sepatutnyaterbuka kepada  pengambil alihan bukansahaja syarikat swasta tempatan tetapi juga syarikat-syarikat  antarabangsa yang berminat  melibatkan diri dalam pembangunan Negeri  Johor dan Iskandar Malaysia. 

YB Dato' Speaker,

Prestasi syarikat kerajaan  perluditeliti dan syarikat kurang berprestasi perlu disusun semula termasuk dijualdalam pasaran terbuka dengan harga terbaik bukan sahaja untuk mengurangkanbeban kewangan kerajaan malahan memerangsangkan pelaburan asing dan domestik,akhirnya memajukan status sosioekonomi Negeri Johor.

YB Dato' Speaker,

Kerajaan Negeri telah menghapus kirahutang YPJ  RM2.52 juta dan hutang SAJ Holdings Bhd RM 27.93 juta. J Corp pula menerima pinjaman baru sebanyakRM 14.61 juta untuk 6 projek.   Tujuanmenubuhkan syarikat kerjaan adalah untuk mengurangkan beban kewangan kerajaan,mudah mudahan membawa pulangan yang lumayan kepada kerajaan di sebaliknya.


Perbadanan Johor

YB Dato' Speaker,

Padatahun  2010, jumlah liabiliti Kumpulan Johor Corporation  adalah  RM 9.3 billion,  aset bersih RM 5.0 billion.  

Namunbegitu liabililti semasa KumpulanPerbadanan Johor sadalah sejumlah RM3,876 juta tetapi jumlah aset semasahanya RM 3,179. Maka jumlah asetbersih semasa Kumpulan perbadanan Johor adalah dengan defisit –RM 697 juta.  

Syarikatinduk Perbadanan Johor  mempunyai jumlahliabiliti RM 4.3 billion,  asset bersih  cuma  RM870 juta, aset bersih semasa RM 410juta pada tahun 2010.

JohorCorporation  menanggung pinjaman sejumlah RM 6.659 billion dandi antaranya RM 2.769 billion  bon Islam akan matang pada tahun depan.

Setakatini Kerajaan Negeri dan Johor Corp belum mengumumkan kaedah mengumpulkan sumberkewangan untuk menyelesaikan bon Islam tersebut.

YABMenteri Besar sepatutnya memaklum kepada Dewan yang mulia ini berkenaanrancangan Johor Corp untuk menyelesaikan bon-bon tersebut.

Penstrukturan Semula Hutang J Corp

YB DatoSpeaker,

PadaOgos tahun ini  Kulim Bhd telah mengambil alih 33,800 ekar tanah ladang dari anak syarikat  Johor Corp, Sindora Bhd dengan bayaran wang tunai   RM700  juta bagi menyeleisaikan sebahagianhutangnya. Harga jualan setiap  ladangadalah  RM 20 ribu seekar atau RM 51 ribu sehektar.

Hargaini dipercayai lebih rendah daripada harga pasaran. Oleh itu, Kerajaan Negeri  Besar diharap membentangkan laporan penilaiankepada  Dewan yang mulia ini  supaya meyakinkan para pelabur bahawasyairkat-syarikat kerjaan negeri akan diruskan secara tulus.

Yb dato'Speaker,

Johor Corp  sepatutnya lebih efisien dalam usaha menyusunsemula liablitinya, lebih behemah dalam pengurusan supaya  dapat menarik pelaburan asing ke IskandarMalaysia dan Negeri Johor secara besar-besaran.  

Langkah-langkahyang berani untuk meliberasikan ekonomi Johor dan Iskandar Malaysia  seumpamanya tender terbuka untuk syarikattempatan dan asing mengambil alih syarikat-syarikat kerajaan yang "sakit" perludipertimbangkan.

Dijangka30% anak syarikat Johor Corp  telah menjadi dorman atau tidak beroperasi. Anak-anak syarikat yang dorman dankurang berprestasi sepatutnya dijualsecara terbuka di pasaran kepada bukan sahaja syarikat tempatan tetapi jugasyarikat anatrabangsa jika Iskandar Malaysia ingin dijadikan sebagai tumpuanpelaburan asing dan domestik.

Menyusun Semula Syarikat Kerjaan dan Badan berkanunBetindih atas Fuingsi

YB Dato'Speaker,

Anak Syarikat Johor Corp (milik saham 75%), Johor SkillsDevelopment  Center Sdn Bhd atau Puspatari  berfungsi sebagai pusat latihan kemahiranindustri  atas kerjasama KementerianSumber Manusia  dan  penajaan geran Kementerian Kewangan. 

Keuntungan sebelum cukaiPuspatari menurun dari RM 2.99 jutapada tahun 2007 ke RM 1.69 juta pada tahun 2009. Lagipun pengambilan pelajarPuspatari tidak mencapai sasaran, iaitu 2.7%-100%bagi kursus-kursus jangkamasa panjang,83.6-88.5% bagi kursus-kursus jangkamasa pendek. 

Pengambilanpelajar yang jauh dari sasaran telah membazir sumber kewangan kerajaansedangkan membawa kerugian kepada syarikat kerajaan.

Disebaliknya  YPJ juga menjalankan program pendidkan dan kemahiran yang bertindihdengan Puspatari.  Jumalah pendaftaranpelajar ke institut dan kolej KumpulanPendidikan YPJ di antara tahun 2008dan 2010 tidak mencapai sasaran malahan semakin menurun, iaitu 37.5%, 52.3% dan 31% dari tahun 2008 hingga2010.

MemandangkanKPYPJ mengalami kerugianberturut-turut di antara tahun 2007 dan 2009,  operasi institut KPYPJ dan Puspatari perlu disatukan untuk menjimatkankos operasi dua-dua syarkat kerajaan yang sebenarnya bertindih dari segi fungsimereka sebagai pusat pendidikan dan latihan kemahiran.

Salah satu pendekatan yang efektif untuk mengurangkankerugian syarikat kerjaan adaah menyatukan pengurusan   syarikat kerajaan dan badan berkanun yangbertindih fungsi mereka.

Pengurusan YPJ 

YPJmemainkan peranan yang mustahak dalam usaha mempertingkatkan taraf pendidikandan tenaga manusia di Negeri Johor. Oleh itu, keadaan kewangan dan prestasi YPJ/KPYPJ mesti diteliti di Dewanini.

YB Dato'Speaker,

Pada tahun 2009 pelaburan YPJ dalam anak syarikat sejumlah RM 261 juta tetapi 24% atauRM 61 juta pelaburan YPJ tidap dapat disahkan sebab ketiadaandokumen dikemukakan diaudit.

Jumlah penghutang YPJ pada tahun 2009 adalah RM 8.54 juta. 88.8% hutang atau RM 7.59 juta tidak dapat disahkan kebenaran kerana dokumen tidak dikemukakanuntuk diaudit.

YB Dato'Speaker,

Sayamasih ingat lagi pada masa dahulu taukeh-taukehkedai runcit pun tahu apa maknanya akauntabiliti. Semua penghutang kedairuncit mesti diberikan buku nota kecil "555"dengan  catatan   butiran hutang selaras dengan catatan amaunhutang dalam buku hutang besar taukeh kedai terbabit.

Padahujang bulan bila nak bayar hutang, penghutang mesti membawa buku 555 dantaukeh kedai runcit akan memastikan jumlah hutang dalam selaras di anatara bukukecil 555 dan buku besarnya sebelum penghitang diminta menjelaskan hutang.

Jika Pengarah dan ahli Lembaga YPJ tidak mengertimaknanya akauntabliti dalam pengurusan, mereka sepatutnya dihadiahkan buku 555supaya mereka mempelajari ilmu pengurusan  dan tanggung jawab  dari taukeh kedai runcit.

Anaksyarikat YPJH iaitu YPJ Corporatoion SdnBhd telah melabur dalam saham  siar harga Ranhill Bhd. berjumlah  RM 70juta pada tahun 2009 tetapi harga saham berkenaan menurun kepada RM 25 juta. Oleh itu, YPJ Corporation Sdn Bhd mengalami kerugian RM 44 juta disebabkanpelaburan yang bersiko tinggi.

Sepertiyang dikatakan dahulu, pentadbir kerajaan dan pengurus syarikat kerajaan mestimenjadi pelabur yang bijak dan berwaspada. Janganlah berlagak kaki judi yangsuka mengambil risiko tinggi tanpa mempertimbangkan akibat buruk berpunca darisikap "mian-main judi" mereka.

YPJmerupakan badan berkanun yang ditugas dengan misi membangun pendidikan danlatihan kemahiran di Negeri Johor.  Olehitu, YPJ sepatutnya lebih berhemah dari segi perbelanjaan dan pelaburan sertamengkaji kemungkinan mengadakan program francais bersama dengan sektor swastauntuk mengurangkan kerugian.

Padatahun 2010 warga asing yang menetap di Johor telah mencecah 293 ribu orangiaitu 8.9% dari 3 juta penduduk Johor. Kadar warga asing sepatutnya diseimabngkan tidak melbihi kadar 5%. Jika kadarwarga asing terlalu tinggi speperti yang berlaku di Sabah, 27% penduduk Sabahterdiri daripada warga asing. Kadar warga asing terlalu tinggi akan menjejaskanpeluang pekerjaan  dan taraf gaji warganegara.

Usahlahkita bersikap emosi kepada isu menyusun semula bilangan penjawat awam sebab bilanganpenjawat awam terlalu ramai akan menjejaskan ekonomi dan membebankan tanggungankerajaan sedangkan sektoe swasta memerlukan tenaga manusia mahir yangberamai-ramai khasnya selaras dengan pembangunan Iskandar Malaysia.

Jepun mempunyai bilangan penjawat aawam yang sama denganMalaysia iaitu 1.2 juta. Tetapi bilangan poenduduk jepun adalah 5 kali gandabilangan penduduk Malaysia. Oleh itu, bilangan penjawat awam  perlu dikurangkan manakala pertukaran tenagamanusia di antara sektor awam dan swasta dapat mengintegrasikan  dua-dua sektor.

Budaya Orang Asli Seletar atauorang Laut merupakan pusaka Kesultanan Johorseperti tercatat dalam penulisan ProfessorZainal Abidin Borhan. Baru-baru ini terdapat hak milik tanah sebahagianbesar Kpg Sungai Temun, penempatan Orang Seletar telah diambil alih oleh Nodedua Sdn Bhd  anak syarikat Iskandar Investment tanpapengetahuan dan persetujuan orang Asli Seletar.

Sebagaipenduduk asal pertama di tanah air kita, hak-hak Orang Asli belum terjamin dibawah undang-undang dan perlembagaan khasnya terhadap hak milik tanah adatmereka.  Jika Negara-negara Barat dapatmenjamin hak-hak tanah Orang Asal atau pribumi melalui penempatan tanah  rizab , Negeri Johor sepatutnya menggubal satuEnakmen demi mempertahankan hak milik Orang Asli terhadap tanah  adatmereka.

Tambahnya,Kpg Orang Seletar Pasir Salam, Ulu Tiram belum dibekalkan dengan elektrik danair paip sedangakn kampung-kampung berdekatan lain telah lama disiapkaninfrastruktur. Saya telah membawa isu ini kepada perhatian JHEOA  dan YAB Menteri Besar, tetapi belum adasebarang tindakan dari pihak berkuasa.

Jangalahdikatakaan Kerjaan Johor bertamaddun, hak asasi milik tanah Orang Asalterabai.

Banjir Lumpur kilat masihsering berlaku di Kampung Poh Chee Leng,Skudai, dan Kawasan Jalan makmur Taman Damai Jaya selama sepuluh tahunekoran pembinaan Kem Tentera Skudai yang telah terbengkalai selama 8 tahun.

Sehubungdengan Laporan Ketua Audit Negara 2009, PAC Parlimen  telah  mebuat lawatan ke tapak Kem Skudai pada bulanMei lalu serta mengenalpastikan   tanggungjawab Pemaju KCSB  terhadap penyenggaraan kolam kelodak di tapak terbabit.

Banjir kilattelah berlaku 3 kali iaitu 23 hb September 2010, 18 Mei dan 20 November tahunini yang melibtakan 100 keluarga di Kawasan Jalan Makmur,  kediaman Taman Damai Jaya. Pada purata banjirkilat setiap kali memakan masa 2-3 jam yang ditolak bantuan kewangan bencanasebab setiap kejadian kurang dari 6 jam.

Para pendudukterlibat menyuarakan ketidapusan sebab 3 kali banjir kilat telah mendatangkankerugian yang besar sedangkan setinggan-setinggan yang menduduki tanah rizabJPS diberikan batuan JKM.

Oleh itu, saya berharap pihak berkenaan akanmeluluskan permohonan bantuan ikhsan mangsa  banjir di kawasan Jalan Makmur Taman DamaiJaya.

Secararingkas dan cemas,  penduduk-penduduk PangsapuriHang Lekir Taman Skudai Baru, Flet Taman Impian Mas, Taman Skudai Baru, PangsapuriBandar Selesa Jaya dan Sri Awana Apartment  Bandar Selesa Jaya  merayu kepada PBT supaya perhentian basterteduh dibina dan khidmat bas dipulihkan dengan jadual tetap.

KUALA LUMPUR, Dec 13 — Many Christians feel victimised and are convinced they are being used as political pawns to win Muslim votes in the next general election, a number of church leaders have said.

The church leaders told the New York Times in a report published today that there was generally a feeling of Christian-bashing among the community which makes up less than 10 per cent of the population and consists of most major denominations.

"I think Christians are generally feeling that there is kind of a Christian-bashing going on," Council of Churches Malaysia (CCM) vice-president Rev Thomas Philips told the newspaper.The report pointed out that recent events had worsened religious tension here, particularly after the controversial August 3 raid on the Damansara Utama Methodist Church (DUMC) in Petaling Jaya.

During the incident, Islamic religious authorities had moved in on a dinner function held at the church premises after receiving complaints that Christians were proselytising to Muslims there.

While no concrete proof was found and no action taken, Muslim politicians here and Muslim group Himpun had continued to claim of a plot by opposition parties and Christian organisations to Christianise the country.

The NYT pointed to Himpun's series of planned nationwide rallies to "save and protect" Islam and cited Umno information chief Datuk Ahmad Maslan's recent statement as examples of the continuing accusations causing "unease" in the Christian community even as they prepare for Christmas.

During the just-concluded Umno annual general assembly, Ahmad had warned that Islam would be "lost" if Pakatan Rakyat  (PR) made significant gains in the polls and had called the DAP "agents of Christianisation".

Under fire for his words later and dubbed as "Hitler" by his opposition foes, Ahmad chose to stick to his guns, insisting that his statement was nothing but the truth.

"It's unfortunate that the authorities don't take the relevant action against those making such wild allegations. We are upset about that. There's a sense of justice is not done. We have not done anything wrong," the NYT quoted Bishop Jason Selvaraj of St Mary's Anglican Cathedral as saying.

The daily noted that although Malaysia's Constitution provides for freedom of religion and designates Islam as the religion of the federation, Muslims here are free to proselytise to others while those of other faiths are barred from doing so to Muslims.

But Christians here, it said, have denied attempting to proselytise.

"The present climate and mood is more political than anything else. They are thinking that it will unite the Muslims together, but I don't think that any Malaysians buy it. It's a political game," Catholic weekly The Herald's editor Rev Lawrence Andrew told the newspaper.

But according to political analysts interviewed by the daily, capitalising on religious sensitivities in this manner could prove detrimental to the ruling Barisan Nasional (BN) coalition in the long run.

Quoting Nanyang Technological University political science professor Farish Ahmad Noor, the daily wrote that the move could alienate Umno's non-Muslim affiliates in BN as well as ward off Christian support.

"If this (conservative) fringe in Umno thinks this is the only way they can secure the Malay vote, they have to understand that the coalition as a whole has to secure the votes of as many Malaysians as they can, and that includes Christians," he said.

The Computing Professionals Bill 2011: An Orwellian "Big Brother"

The draft Computing Professionals Bill 2011 (CPB2011) which is currently being circulated for "consultation" is an attempt by MOSTI to regulate all "computing services" provided to entities or persons related to the "critical national information infrastructure" (CNII).

"Computing services" is defined as any services provided to "plan, architect, design, create, develop, implement, use and manage information technology systems". Based on this definition, the scope of such services would cover anything from designing websites to the setting up of computer servers to the design and development of any computer products - whether software or hardware. In fact, one would easily classify the setting up of blogs and news portals, or even use of Facebook and Twitter accounts as being covered under "computing services".

"CNII" on the other hand, is defined as "those assets, systems and functions that are vital to the nation that their incapacity or destruction would have a devastating impact on National economic strength or National image or National defense and security or Government capability to function or Public health and safety".

CNII could hence cover any entity in the Government, financial institutions and government linked companies. What is absolutely frightening is the definition would also cover all the way to any website, portal or information technology application which could have a detrimental impact on the "National image" or deemed to hurt the "Government's capability to function".

Any ambiguity in the law shall be determined by the 15 imember "Board of Computing Professionals" appointed at the sole discretion of the Minister, and subjected only to the Minister's approval.

Contrary to the clarification statement made by MOSTI, which claimed that the bill does not restrict the practise of "computing services" and is only limited to CNII, the bill has pervasive and damaging consequences not only on the information technology industry, but also infringes on key Goverment commitments under the Multimedia Super Corridor (MSC) Bill of Guarantees.

The Bill of Guarantees have promised "unrestricted employment of knowledge workers" and "no censorship of the Internet". However the CPB 2011 will clearly restrict the hiring of knowledge workers by necessitating registration. Similarly, the CPB 2011 as it is currently defined could be used to register, regulate and restrict the activities of individuals or corporations to publish news reports or those who use Facebook, Twitter or other similar applications with the excuse of protecting the "National image".

It is clear that the flimsily drafted CPB has the Orwellian "big brother" fingerprints all over it.

The information technology and computing industry has been operating without controversy, issues or impediment for the past decades. There is absolutely no bureaucratic requirement to restrict and control the industry, which will only bring adverse outcomes without any corresponding tangible benefit.

I will personally attend the CPB 2011 Open Day organised by MOSTI tomorrow to hear the Ministry's clarifications on the bill, and to submit the relevant points of objection.
