Kedai Rakyat 1Malaysia - Not Cheap At All Posted: 09 Nov 2011 11:25 PM PST Barisan Nasional leaders should stop propagating misleading claims and making false advertisements promoting how cheap Kedai Rakyat 1Malaysia (KR1M) products are when they are not. "Items at Kedai Rakyat are markedly cheaper than those in supermarkets and hypermarkets and helps families cut down on their expenses without losing out on quality." The first Kedai Rakyat 1Malaysia was opened by Prime Minister Datuk Seri Najib Razak in June offering goods at 30 to 50 per cent lower than the market prices of similar products. (Domestic Trade, Cooperatives and Consumerism Minister Datuk Seri Ismail Sabri Yaakob, New Straits Times 27/8/2011) Prime Minister Datuk Seri Najib Tun Razak launched the first of many 1Malaysia shops in the country, designed to help bring down the prices of goods and ease the burden of the common man… Najib said the shop retailed 250 grocery items under the brand name "Kedai Rakyat 1Malaysia" at prices 30% to 40% lower than market prices… He said it would also allow the Government to get basic necessities at the cheapest prices from Mydin whenever there were disasters like flood. (The Star 23 June 2011) Semua kedai koperasi sekolah dan kedai runcit koperasi disaran menjual produk 'Coop 1Malaysia' (Coop 1M) bagi membantu kerajaan mengekang masalah kenaikan harga barang. Menteri Perdagangan Dalam Negeri, Koperasi dan Kepenggunaan, Datuk Seri Ismail Sabri Yaakob berkata, melalui langkah itu, warga sekolah dan ibu bapa mempunyai satu lagi alternatif untuk mendapatkan barangan keperluan dengan harga berpatutan. (Utusan Malaysia 3 November 2011) Sample product advertisements on KR1M website: A shopping trip to a local hypermarket such as Carrefour buying products ranging from condensed creamer to canned sardines to dishwashing liquid will immediately show that the truth is far from the outrageous claims made by the Domestic Trade, Cooperatives and Consumerism Minister and the Prime Minister. While some products are indeed cheaper in the Kedai Rakyat 1Malaysia (KR1M), the price differential is far less than the claims of 30% to 50% for most products. For example, KR1M claim to sell a 425gm can of sardines for RM2.99 "saving" the consumer a whopping 51%. However, a check in Carrefour showed that a 425gm of sardines (Double Swallow brand) sells for RM2.49 or 20% cheaper than in KR1M! For a 1 litre bottle of 1Malaysia bleach, KR1M will charge you RM1.90, claiming huge savings of 36%. However, one can easily purchase 1 litre of Carrefour or Tesco branded bleach for only RM1.29 or a massive 47% cheaper than in KR1M! Even when the 1Malaysia products are indeed cheaper, they are nowhere the claimed "savings". For example, for a 400gm packet of frozen minced beef, it would cost RM4.89 in KR1M. In Carrefour, the Ramly branded packet will cost RM5.29 or only 8% more, instead of the claimed 18% "savings". Based on a basket of 23 common daily household goods and food items compiled per the attachment, it showed that if the same items are bought in Carrefour, a consumer will actually save 8%, paying RM120.53 instead of RM130.49 in KR1M. The manner which KR1M and the Barisan Nasional cabinet ministers have been going to town telling the rakyat how ridiculously cheap the products sold in KR1M is completely irresponsible and misleading. In fact, the Ministers and KR1M should be investigated for breaching the Malaysian Code of Advertising Practice (MCAP). For example, the code says that "Advertisements should not contain any statements or visual presentation which directly or by implication, omission, ambiguity, or exaggerated claim, is likely to mislead the consumer about the product advertised, the advertiser, or about any other product or advertiser, in particular with regard to… value or total price actually to be paid." In fact it is the Domestic Trade, Cooperatives and Consumerism Ministry which is responsible for regulating the industry and ensuring that consumers are not cheated by misleading claims under the Consumer Protection Act 1999. However, when the Ministry itself is guilty of such offences as a result of the Barisan Nasional government's vested interest in KR1M, then it becomes a gross breach of its responsibility to the rakyat. We call upon the Ministers and KR1M to stop misleading the rakyat with false advertising and make claims which can only be substantiated with comparisons with products of equivalent quality. We are very happy if the Government can promote quality products which are cheaper to the rakyat but such promotions should apply to any company capable of delivering cheaper prices and not completely biased support towards 1 company who may or may not offer cheaper prices. In fact we note with trepidation that the Government is taking the opportunity to force various government-related agencies to take and offer KR1M products – such as the announcement on Coop 1Malaysia in schools and the setup of Kedai Rakyat Majlis Agama Islam Wilayah Persekutuan (MAIWP). We fear that the measures will end up only profiting certain business entities instead of offering real quality products at the cheapest possible prices to the man on the street. UMNO Hypocrites Over Civil Service Posted: 08 Nov 2011 11:09 PM PST The racist reactions by Umno politicians to proposals to improve the efficiency of our civil service and government expenditure prove that the Party prioritises only its bigoted political interests and marginalises the needs of the nation I am almost amused by the "shock and fury" expressed by Umno politicians, the far-right Perkasa and Umno-owned Utusan Malaysia on a straightforward comment which I had made in a forum in Johor Bahru on 30th October 2011, in response to a question posed by a member of the audience. I had presented at the Budget 2012 forum the rising Government operating expenditure and the fact that the largest and fastest rising component of the expenditure is the allocation for "Emoluments, Pensions and Gratuities". I had shown the chart below which clearly highlights the rise of the Government's total wage bill:  The chart shows that our total civil service wage bill has increased from RM20.9 billion in 10 years ago in 2001 to RM30.2 billion 5 years ago in 2006 to a massive RM64.1 billion expected next year in 2012. The member of the audience had asked, what could be done to resolve the issue. I said that this matter will be one which is highly sensitive and a very difficult issue to deal with. I had specifically emphasized that the civil service cannot be reduced overnight and any rationalisation of the civil service has to be conducted over the long term. I had offered certain suggestions such as the termination of civil servants who have failed to perform their responsibilities as well as offering optional early retirement programmes for those who are interested. However, the reaction from the UMNO chauvinists clearly showed that they are not interested in solving the problem but are more interested in inflaming racial sentiments and making irresponsible wild allegations with the sole purpose of creating racial hatred. It was perhaps most disappointing to hear the widely respected and normally rational, MP for Johor Bahru, Datuk Shahrir Samad stooping so low as to turn a healthy discussion on the size of the civil service into a racial issue. He has said that "Motif mereka hanyalah mahu menaikkan sentiment rasis dan bukannya berasaskan ekonomi." The reaction by the Johor Bahru MP, other Umno politicians and Perkasa is completely hypocritical for it was the Prime Minister, Datuk Seri Najib Razak himself who has proposed a new civil service scheme for the government workforce. In his Budget 2012 speech, the Prime Minister himself had proposed that "a flexible remuneration system will be introduced to retain or terminate civil servants based on performance. Civil servants must accept this challenge and be prepared to change. Hence, the Government will introduce the New Civil Service Remuneration Scheme or SBPA [will] introduce an exit policy for underperforming civil servants and for those who opt to leave the service". Why is it that these very critics and race-champions have not raised a single note of objection to the Datuk Seri Najib Razak's proposal but when the same issue is raised by an opposition politician, then all hell breaks loose. In fact, even the Chief Secretary, Tan Sri Sidek Hassan has said the same when questioned by reports the day after the Budget speech where "…he insisted that the "exit policy" announced in Budget 2012 would be strictly enforced." "If you want to go out, we will allow you to go out. When we think that it is better off for you for a civil servant to be outside the public service, then we will allow them to go out. When they misbehave, and we think they should go out, we'll ask them to go out," he said. Therefore Datuk Shahrir and all other shameless critics should focus on the task at hand as put forth by the Prime Minister and the Chief Secretary themselves and stop playing racial politics with the sole purpose of inciting racial hatred among Malaysians for the purposes of shoring up declining support for an UMNO that is bankrupt of ideas. UUCA Appeal Defies "Political Transformation Programme" Posted: 05 Nov 2011 11:40 PM PDT The decision by the Cabinet to allow the appeal of the Court of Appeal judgement that Section 15.(5)(a) of the University and University Colleges Act 1971 (UUCA) is unconstitutional flies in the face of the Prime Minister's "political transformation programme" After a series of calls for the Government to not appeal the Court of Appeal judgement that Section 15.(5)(a) of the UUCA is made by top politicians from both Barisan Nasional and Pakatan Rakyat, hopes were high that the Cabinet will abide by and accept the Court's decision. The UMNO Youth Chief, Khairy Jamaluddin, Deputy Higher Education Minister, Dato' Saifuddin Abdullah and MCA Youth Chief, Datuk Wee Ka Siong have made a show of openly supported the Court's position that the relevant section of the UUCA is unconstitutional and the UUCA should be amended accordingly. In the "spirit" of the political transformation programme launched by the Prime Minister, Datuk Seri Najib Razak on the eve of Malaysia Day where he announced the proposed repeal and amendment of various draconian Acts such as the Internal Security Act (ISA) and the Printing Press and Publications Act (PPPA), Malaysians were expecting an enlightened decision by the Cabinet to finally remove the shackles of academic freedom at our institutions of higher learning. However, the BN government has instead chosen to abdicate its responsibility to the Attorney General, purportedly to make a study of the "points of law". The excuse could not be more lame as regardless of the Court decision, the Cabinet could have taken opportunity to announce a proposed amendment of the UUCA, particularly the controversial Section 15. In fact, the Cabinet should have taken the bold decision not only to amend Section 15.(5)(a), but the entire Section 15 of the Act which severely restricts the freedom of academics and students in our local universities. Section 15.(1) states that students of the University, even if they are of voting age or PhD students, cannot be members of any political party, or any other organisation as determined by the Minister of Higher Education. Section 15.(2) states that no University students' body shall have any association with any political party, or any organisation as determined by the Minister of Higher Education. Section 15.(6)(a) states that students and academics will only have the "freedom" to make statements on their areas of study and research while 15.(6)(b) prohibits their participation in any seminar, symposium or event organised by any political party, even if it is within their area of expertise. The above sections of the Act are obviously unreasonable and unconstitutional on so many grounds – such as the Article 8 which states that "all persons are equal before the law" forbidding discrimination against students and academics; and Article 10 which guarantees the "freedom of speech and expression" as well as "the right to form associations". I have filed the proposed amendments to the above Sections of the Act during the sub-committee debate on the UUCA Amendment Bill in December 2008 arguing on its unconstitutionality. However, the motion was defeated unanimously by the BN members of Parliament. We call upon the Cabinet not to make the same mistake twice, at the expense of not only the Prime Minister's "political transformation programme", but also the reputation and credibility of our institutions of higher learning. Without academic freedom, our universities will never be able to achieve our goals of becoming "world-class" institutions. Regardless of the final decision by the Attorney-General, Datuk Seri Najib Razak must retake the initiative and commence the process of removing all unconstitutional and unreasonable elements from the UUCA. Lim Guan Eng Posted: 11 Nov 2011 02:12 AM PST Lim Guan Eng 5 Reasons Why Penang Will Not Go To The Polls This Year If Prime Minister Dato Seri Najib Tun Razak Calls For Snap Elections.(en/bm/cn) Posted: 10 Nov 2011 11:31 PM PST As speculation rises whether Prime Minister Dato Seri Najib Tun Razak will call for snap elections on this auspicious date of 11 November 2011, there are 5 key reasons why Penang will not follow suit and hold concurrent elections with the federal parliamentary seats this year. One, BN has still not fulfilled its promise to repeal the Internal Security Act and disbursed RM 500 to all households earning below RM3,000 per month. Questions are raised as to whether BN will conduct a mere cosmetic exercise of repealing the ISA but replacing it with two ISA-like laws. resulting in Malaysians ending up with two ISAs instead of one. The disbursement of RM100 to students this year when this measure is included in the budget is for 2012 and not 2011 raises questions of legality especially when the 2012 Budget has still not being passed in Parliament. Further if the RM100 is to be paid this year when it is not budgeted in this year 2011 budget, where is the Federal government getting the money from. Lest we forget Malaysia recorded a budget deficit this year as has been a deficit for 15 years. The National Deficit for 2010 is RM43.27billion, for 2011 is RM45.51 billion whilst the 2012 projected deficit for is RM43billion. (4.7% out of RM918 billion nominal GDP projected). Where is the Federal government going to get the extra RM530 million for giving to school students RM100 this year when it is not budgeted for 2011 and will only increase the 2011 deficit further? Two, holding general elections now would be unfair to those performing the haj as they will be denied their right to vote and determine the next government. The last batch of the Haj pilgrims are not expected back until Dec 11 and almost 30,000 Malaysians went to Mecca to perform their pilgrimage Three, the failure and refusal by the BN government to explain the misappropriation of funds, gross irregularities and abuses of power as outlined in the 2010 Auditor-General's Report. The 2010 Auditor-General Report reminds Malaysians of everything that is wrong in the BN Federal government. The AG’s report also cites poor management as a key factor and points to other failings such as its failure to train enough farmers, a 5,000-acre farmland that is overgrown and poor maintenance of its facilities. Naturally, Malaysians are concerned about public money which includes an additional soft loan of RM250 million being used to fund this “family business”, especially when it is turning out to be a monumental failure. In addition, Sharizat has still to deny reports of how the funds were used on non-cow related purposes including an allegation by PKR that nearly RM10 million was spent to purchase a high-end condominium. Four, the Parliamentary Select Committee of Electoral Reforms have still not completed its hearings to carry out reforms to ensure a free, fair and clean elections. Failure to do so would permit the dirtiest general elections in history with phantom voters and illegal immigrants being transformed magically to citizens and voters in a few hours. Would Malaysia's destiny be determined by Malaysian citizens or phantom voters and illegal immigrants? Five, the national agenda for the end of this year should be focused on flood prevention and mitigation. Malaysians should learn from the horrors of floods in Thailand that has caused tragic loss of life and huge financial losses. To hold general elections now during the rainy monsoon season when flood victims are more bothered about surviving than voting, would be not only be a denial of their democratic right of choice but cruel and inhumane. If Najib insists on calling snap polls this year, then the Penang Pakatan Rakyat will hold a special convention where a recommendation will be made not to hold the state election together with the federal parliament. —–BM Translation——— Kenyataan Akhbar oleh Ketua Menteri Pulau Pinang Lim Guan Eng di Kuala Lumpur pada 11.11.2011 5 Sebab Kenapa Pulau Pinang Tidak Akan Mengadakan Pilihanraya Tahun Ini Jika Perdana Menteri Dato' Sri Najib Tun Razak Memutuskan Untuk Mengadakan Pilihanraya Kilat. Sementara spekulasi bertiup kencang bahawa Perdana Menteri Dato' Sri Najib Tun Razak akan membubarkan Parlimen pada tanggal bertuah 11 November 2011, terdapat 5 sebab kenapa Pulau Pinang tidak akan mengikutinya jika pilihanraya diadakan pada tahun ini. Pertama, BN masih belum lagi menyempurnakan janji untuk memansuhkan Akta Dalam Negeri (ISA) dan pengagihan RM500 kepada semua isi rumah yang berpendapatan kurang daripada RM3,000 sebulan. Soalan sedang ditimbulkan sama ada janji pemansuhan ISA ini merupakan wayang semata-mata, kerana pada masa yang sama kita diberitahu bahawa ISA itu akan digantikan dengan dua lagi undang-undang yang serupa. Jika itu berlaku, Malaysia bukan sahaja akan mempunyai satu ISA, tetapi dua. Bayaran RM100 kepada setiap pelajar yang dilakukan pada tahun ini menimbulkan soalan kesahihan, terutamanya apabila Belanjawan 2012 belum lagi diluluskan oleh Parlimen. Dan jika pembayaran RM100 akan diberi pada tahun ini memandangkan ia tidak diperuntukkan dalam Belanjawan 2011, dari manakah datangnya duit yang ingin dibelanjakan oleh Kerajaan Persekutuan ini? Jangan kita lupa bahawa Malaysia telah mencatatkan defisit belanjawan pada tahun ini, sepertimana defisit telah dicatatkan untuk 15 tahun berturut-turut. Defisit negara bagi tahun 2010 adalah RM43.27 bilion, dan untuk tahun 2011 pula RM45.51 bilion, manakala unjuran defisit untuk 2012 adalah RM43 bilion (atau 4.7% daripada unjuran nominal KDNK RM918 bilion). Di manakah Kerajaan Persekutuan akan mendapat lebihan RM530 juta untuk pemberian RM100 kepada setiap pelajar sekolah tahun ini apabila ia tidak diperuntukkan dalam tahun 2011? Dan bukankah ini akan menambahkan defisit negara? Kedua, adalah tidak adil untuk menafikan hak mengundi kepada jemaah Haji yang sedang menunaikan ibadah mereka jika pilihanraya umum diadakan sekarang. Kelompok terakhir jemaah Haji hanya dijangka kembali pada 11 Disember. Seramai 30,000 rakyat Malaysia telah ke Makkah untuk menunaikan ibadah Haji pada tahun ini. Ketiga, kegagalan dan keengganan Kerajaan BN untuk menjelaskan penyelewengan dana, penyalahgunaan kuasa dan ketidakseimbangan yang nyata seperti yang telah digariskan dalam Laporan Ketua Audit Negara 2010. Laporan tersebut telah mengingatkan rakyat Malaysia tentang segala kekurangan dan kesalahan dalam pentadbiran Kerajaan BN. Sepasang binokular marin 'visi malam' yang berharga RM1,940 telah dibeli pada harga RM56,350; set TV LCD dan pemain DVD telah dipesan dengan harga kontrak RM16,100 tetapi yang dibekalkan merupakan set jenama bermutu rendah yang berharga RM195; RM770,000 pula telah dibelanjakan untuk membekalkan tenaga elektrik kepada satu rumah. Laporan Ketua Audit telah menyatakan bahawa 9 buah kementerian atau jabatan telah terlebih membelanjakan peruntukan dengan jumlah sebanyak RM3.73 bilion. Menteri Datuk Shahrizat Abdul Jalil pula terlibat dengan skandal Pusat Fidlot Nasional (NFC) yang bernilai RM73.6 juta, apabila projek itu telah diberikan kepada keluarganya. Suami Datuk Shahrizat merupakan Pengerusi Eksekutif manakala anaknya menyandang jawatan Ketua Eksekutif (CEO). Anak-anak lainnya pula berjawatan Pengarah Eksekutif. Banyak soalan belum dijawab tentang projek Fidlot di Gemas, Negri Sembilan, seperti pengeluaran lembu yang tidak mencapai sasaran, di mana 3,289 ekor telah dikeluarkan dalam tahun 2010, atau 41.1 peratus daripada 8,000 ekor yang disasarkan). Laporan Ketua Audit Negara juga telah menekankan pengurusan yang tidak cekap sebagai faktor utama untuk prestasi lemah yang dicapai, di samping mengemukakan kegagalan untuk melatih petani yang cukup, tanah 5,000 ekar yang bermensiang dan tidak terjaga serta penyenggaraan yang kurang memuaskan. Oleh itu, rakyat Malaysia berasa bimbang dengan penggunaan wang rakyat, yang juga sekarang membabitkan pinjaman RM250 juta untuk membiayai "bisnes keluarga" ini, apatah lagi apabila projek ini nampaknya akan menjadi satu kegagalan yang besar. Tambahan pula, Shahrizat belum lagi menafikan laporan bahawa dana itu telah digunakan untuk tujuan lain seperti yang didakwa oleh PKR bahawa hampir RM10 juta telah digunakan untuk pembelian sebuah unit kondo mewah. Keempat, Jawatankuasa Pilihan Khas Parlimen untuk reformasi pilihanraya masih belum lagi selesai dengan pendengaran awamnya untuk melakukan perubahan demi menzahirkan pilihanraya yang bebas, bersih dan adil. Kegagalan untuk melaksanakan perubahan ini akan membolehkan pilihanraya yang paling kotor dalam sejarah dengan pengundi hantu dan juga pengundi asing yang diberi kerakyatan secara pantas dan ajaib. Adakah nasib dan takdir Malaysia akan ditentukan oleh rakyat kita sendiri ataupun pengundi hantu dan pengundi asing? Kelima, agenda kebangsaan menjelang akhir tahun ini patut ditumpukan kepada tindakan mitigasi dan pencegahan banjir. Malaysia harus belajar daripada kengerian banjir di Thailand yang telah mengakibatkan kehilangan nyawa yang tragis dan kerugian kewangan yang besar. Jika pilihanraya umum diadakan semasa musim tengkujuh, ia bukan sahaja akan menafikan hak demokratik mangsa-mangsa banjir tetapi juga bersifat tidak berperikamanusiaan. Jika Najib berkeras untuk mengadakan pilihanraya kilat pada akhir tahun ini, Pakatan Rakyat Pulau Pinang akan menganjurkan sebuah konvensyen khas di mana cadangan akan disyorkan supaya pilihanraya negeri tidak akan diadakan bersama dengan pilihanraya umum. Lim Guan Eng —— Mandarin Translation —- 槟州首席部长林冠英于2011年11月11日在吉隆坡发表声明： 如果首相拿督斯里纳吉宣布选举，槟州不会与联邦政府同步举行州议会选举的五个原因。 很多人猜测首相拿督斯里纳吉会在2011年11月11日这个黄道吉日宣布解散国会进行国会选举，槟州政府将不会与国会同步进行选举，五大原因如下： 第一、国阵还没有兑现他们的承诺，废除内安法令、派发500令吉给收入3000令吉以下的家庭。人们要问国阵是不是在玩弄把戏，一边说要废除内安法令，另一方面却用另外两项法令取代，导致国人最终被两条内安法令压迫。 有关国阵派发100令吉给每一名学生的措施是属于2012年财政预算案，不是2011年的财政预算，特别是当2012年预算案还没有在国会通过。再说，如果这100令吉不是2011年的预算，而政府要在今年派发，我们要问联邦究竟钱从哪里来？ 别忘了马来西亚今年的财政预算破记录，这已是第15年的赤字预算。2010年国家赤字达432亿7000万令吉，2011年为455亿1000万令吉，而2012年预算赤字为430亿令吉（占预计国民生产总值9180亿令吉的4.7%）。今年联邦政府要去哪里找出额外的5亿3000万令吉来派发100令吉给每一名学生，它不在2011年的预算案内，并且只会让2011年的赤字更高？ 第二、现在举行大选，对那些朝圣的人士是不公平的，他们将失去投票选出下届政府的权利。最后一批朝圣人士约在12月11日回国，目前约有3万名马来西亚已经前往麦加朝圣。 第三、国阵政府还无法并拒绝解释一大堆2010年总稽查报告揭发的滥用公款、不寻常运作及滥权的问题。2010年总稽查报告提醒马来西亚人有关国阵联邦政府的问题。当局以5万6350令吉购买一副价值1940令吉的夜用海底望远镜；以1万6100令吉购买只值195令吉的液晶电视和光碟机；花费77万令吉为一所房子提供电供。 总稽查报告也说9个部长或部门去年运作费用超支达37亿3000万令吉，就连拿督莎丽扎也涉及一宗其家人获得价值7360万令吉养牛场项目的弊案。她的丈夫是养牛场的执行主席，而她的儿子是总裁，其余的孩子皆为执行董事。 关于位于森美兰州金马士的国家养牛机构有限公司，当局还有很多问题没有交待。它最大的失败就是2010年它的产量只有3289头牛，仅为目标8000头的41.1%。总稽查报告也说上述公司失败的主因为管理不当、没有培训足够的农夫、5000英亩的农地杂草丛生、设备维护不良。 自然地，马来西亚国人都关心有关公款包括2亿5000万令吉的低息贷款是如何用来资助这个"家族生意"，特别是它已经成为失败的计划。再加上莎丽扎还在否认有关资金用在与养牛生意无关的用途上，包括公正党所揭发的，其中近1000万令吉被用来购买高级公寓。 第四、选举改革国会遴选委员会还没有完成它们的听证工作，确保一个自由、公平及干净的选举。这只会让选举成为史上最肮脏的选举，充斥幽灵选民及短短数小时内由非法移民"转换身份"变成的公民及选民。马来西亚的命运是该由马来西亚人来决定？还是由幽灵选民及非法移民来决定？ 第五，年底的国家议程应该把焦点放在水患防范及纾缓机制。马来西亚国人应该从泰国夺命并造成财物损失的可怕洪水中吸取教训。若在雨季举行选举，对于必须避难而无法行使投票民主权利的水灾灾民而言，是残忍及不人道的。 如果纳吉坚持要在今年举行闪电选举，那么槟州民联将召开特别会议，并提议不与联邦政府同步举行州选举。 林冠英 You are subscribed to email updates from Lim Guan Eng To stop receiving these emails, you may unsubscribe now. SERVANTHOOD Posted: 10 Nov 2011 07:55 PM PST SERVANTHOOD Irregularities in the award of contracts by Rural Development Ministry costing the people at least RM500,000,000.00‏ Posted: 10 Nov 2011 12:53 AM PST Media Statement by YB Ngeh Koo Ham, Member of Parliament for Beruas in Parliament on the 10th Nov 2011: Irregularities in the award of contracts in the Ministry of Rural Development, at least Five Hundred Million Ringgit (RM 500,000,000.00) could have been saved! MACC must conduct investigation immediately. The Minister of Rural Development must explain the irregularities in the award of contracts in his ministry. There are reasons to suspect the existence of rampant corrupt practices. As much as RM 500,000,000.00 could have been saved had the Ministry followed the proper practice of awarding contract to the lowest qualified tenders. I stayed up till 10.30pm in Parliament on Monday (8/11/2011) to debate and to wait for the answer from the Ministry of Rural Development with regard to the issues I had raised. I was greatly disappointed when the Deputy Minister of the Ministry refused to answer my questions. The Rural Development Ministry is awarding 209 projects for the year 2011 and they are numbered KKLW 1/2011 – 209/2011. The Ministry has announced only the award of 129 projects. I have asked what has happened to the other 80 projects. The Deputy has refused to reply. The projects under the ministry were given by direct negotiation, limited tender or open tender. I have asked why projects like the Sarawak Rural Water Supply worth RM638,910,000.00 was given through direct negotiation. The Deputy has refused to give an answer. Other projects given through direct negotiation were the Sarawak Rural Water Supply recticulation system worth RM83,860,000.00 and the Sarawak Special Rural water Supply 2011/2012 project worth RM555,050,000.00 I have informed the Deputy Minister that I have received complaints that the companies that submitted the quotations for projects under limited tender category in many cases were in fact submitted by the same person using different names. The Ministry did not invite separate independent companies to bid for the job. The Deputy Minister also refused to answer whether the allegation is true. Projects No. 9–13, 23–40, 43-46, 51-56, 60, 69-75, 82-92, 100, 101, 110, 115 116, 118-124, 131, 132, 143 and 144/2011 (68 of them) were projects awarded through limited tenders. Although open tenders were conducted for the 68 projects as listed in the schedule hereto, all were not given to the lowest priced bidder except for one. Many of them were awarded at many times more than the lowest price tendered. The Government lost RM403,857,592.72 for its failure to give to the lowest qualified tenders. The proper way to conduct an open tender is to first determine those qualified to bid for the job. Once the qualifying criteria for the tender have been met, the contract must be awarded to the bidder who submits the lowest bid. Such a system will save the government money and be fair to all those who have make the effort to submit the tenders. After taking into consideration, the loss the government suffered through direct negotiation and limited tender projects, I estimate the people lose at least Rm500,000,000.00 through the improper way the above said contracts were awarded. I call on the government to award the balance projects that have yet to be given out to be done in accordance to the abovesaid accepted proper procedure of open tender system. Unless a satisfactory answer is forth coming from the Minister, I call on the Malaysian Anti Corruption Commission (MACC) to immediately conduct investigation as the facts show prima facie that rampant corruption exists in the award of the above said contracts. Posted: 10 Nov 2011 01:11 AM PST DAP National Deputy Chairman and MP for Kepong Dr Tan Seng Giaw calls on the Ministry of Science, Technology and Innovation to step up its efforts to prevent cyber crimes such as hackings. On 10.11.2011, Dr Tan asked additional question in Parliament on Global Cyber Security Association (GCSA) which involves many organizations, public and private, internationally. The cyber world develops very rapidly and its crimes increase proportionately, threatening the security in many fields including banking. What is powerful for good is also powerful for evil. In 2009, the loss due to cyber crimes in Malaysia was estimated as RM13 million and in 2010 RM22 million. In the next five years, it is projected as RM2.73 billion. Among the activities of GCSA are international platform, cooperation between private and public sectors and professionals dealing with increasing cyber threats. Hackers can operate from within and outside the country. Malaysian hackers do not lag behind as shown in the conviction and imprisonment for 10 years of a Malaysian in America recently. The convicted person hacked into banking facilities. Keeping up with new technology and cyber criminal activities is difficult. Besides cooperating internationally, all concerned especially the ministry have to step up the efforts to prevent and to track them.
