A new law that would allow terrorism suspects in Malaysia to be held indefinitely without charge, trial or judicial review, is a shocking onslaught against human rights and the rule of law, said Amnesty International.
"Indefinite detention without trial is contrary to human rights law and it will not stop terrorism. Abandoning people to rot in a cell for years on end without a judicial process and proof that they have committed a crime is just like aimlessly stabbing in the dark. Authorities must ensure that human rights and fair trial guarantees are respected and protected," said Hazel Galang-Folli, Malaysia Researcher at Amnesty International.

Under the newly enacted Prevention of Terrorism Act (POTA), a board will be established to approve detention or restriction orders for individuals "in the interest of security of Malaysia". A suspect can first be detained for 59 days without charge before being presented to the board. This body, which will be appointed by the King and will be outside of the jurisdiction of any court, will have the power to renew detention orders indefinitely. Its decisions cannot be appealed.
The POTA is reminiscent of Malaysia's Internal Security Act (ISA), abolished in 2012, which also allowed for indefinite detention without trial. The new law has not included the necessary safeguards to ensure fair trials and respect of human rights so it could be just as susceptible to abuse as the widely condemned ISA, which was used to unjustly detain government critics and created a climate of fear in the country for decades.
"With the stroke of a pen, Malaysia has managed to get one step closer to becoming a 'human rights black hole' where fundamental rights to a fair trial or freedom of expression and peaceful assembly, even if enshrined in the Malaysian constitution, are increasingly being undermined in the name of national security," said Hazel Galang-Folli.
Today, the Malaysian government also tabled amendments to the colonial-era Sedition Act, including increasing jail terms from three years to up to seven years on conviction and up to 20 years if a suspect is convicted of sedition with causing bodily harm or damage to property. The proposed amendments could also disallow bail for those charged.
In recent months, the Sedition Act has been used to arbitrarily arrest government critics including opposition leaders, human rights defenders, activists, journalists and human rights lawyers.
"Authorities in Malaysia must immediately repeal the Prevention of Terrorism Act and the Sedition Act and release all those who have been detained under it only for expressing their opinions peacefully," said Hazel Galang-Folli.
BANGKOK — Three years after abolishing detention without trial, the Malaysian government revived the practice on Tuesday with the passage into law of a highly contentious antiterrorism bill that opposition leaders fear could be used against government critics.
The bill, the Prevention of Terrorism Act, was passed early Tuesday by a vote of 79 to 60 after more than 10 hours of debate.
The government, which arrested 17 people this week for what the chief of police said was a plot to attack army camps and police stations, has sought to justify the law as necessary to combat the threat of terrorism in Malaysia.
Critics say the law is a further slide toward authoritarianism in Malaysia and a definitive reversal of personal freedoms that Prime Minister Najib Razak vowed to introduce soon after assuming power in 2009.

Aidana, 25, disahkan sebagai gadis berasal dari Kyrgyzstan dan telah memasuki negara ini sejak 2010.
Sejak berada di negara ini, mangsa pernah belajar di Universiti Sunway di Subang Jaya, Universiti Limkokwing di Cyberjaya dan terakhir Kolej SEGi di Kota Damansara.
Ketua Polis Selangor, Datuk Abdul Samah Mat berkata, identiti gadis itu dapat disahkan selepas pihaknya melakukan siasatan termasuk mendapatkan keterangan daripada rakan-rakan mangsa.
Menurut beliau, Aidana tinggal di sebuah apartmen di Pantai Dalam, Kuala Lumpur dan pemeriksaan di kediaman tersebut menjumpai beberapa barang yang membuktikan identitinya.
"Bukti Aidana dikatakan kenalan rapat Clifford berdasarkan tiket penerbangan atas nama mangsa (Aidana) dan juruterbang itu berlepas ke Langkawi pada 21 Mac lalu ketika berlangsungnya Pameran Udara dan Maritim Antarabangsa Langkawi," kata beliau pada sidang akhbar di bilik operasi pasukan penyelamat nahas helikopter di sini semalam.
Abdul Samah memberitahu, walaupun polis mengesahkan identiti mangsa menerusi siasatan namun pihaknya terpaksa menunggu keputusan ujian asid deoksiribonukleik (DNA) mangsa dengan kakak tirinya.
"Jika DNA kakak tiri mangsa gagal dipadankan dengan Aidana, kita akan minta bapa gadis itu datang ke sini melakukan DNA," kata beliau.
Bapa Aidana sudah berusia 75 tahun dan berada di Kyrgyzstan.
Mengulas lanjut, kata Abdul Samah, helikopter AS365N2 Dauphin bukan helikopter pertama mangsa menaiki bersama Clifford.
"Selain itu, maklumat daripada pihak pengurusan kediaman Aidana, dimaklumkan Clifford mempunyai akses untuk memasuki rumah mangsa.
Penerbangan terakhir dengan Jamaluddin Jarjis - Wan Kadri ADUN Bukit Ibam, Datuk Wan Kadri Wan Mahussin tidak menjangka persahabatan antara beliau dan allahyarham Tan Sri Jamaluddin Jarjis berakhir di pintu helikopter. "Saya bersama dengannya 23 tahun, saya kenal dia sudah lama, kami sangat rapat, sahabat saya. "Kali terakhir saya bersama Tan Sri Jamaluddin Jarjis, saya pegang lutut beliau dan salam dengannya," katanya ketika dihubungi Malaysiakini. Penerbangan dengan pesawat AS3655-N2 Dauphin itu merupakan perjalanannya yang terakhir dengan Jamaluddin (kiri), kata ADUN BN itu dengan nada sayu. Sehari sebelumnya, beliau dengan Jamaluddin menaiki helikopter itu bersama dengan lima orang lagi dari Kuantan. Mereka adalah pengawal peribadi Jamaluddin, Razakan B Seran, usahawan Datuk Tan Huat Seang, juruterbang Kapten Clifford William Fournier dan seorang kenalan juruterbang itu, yang dinamakan sebagai Aidana Baizieva, Katanya, penumpang wanita dan juga juruterbang pesawat itu sudahpun berada dalam helikopter tersebut lebih awal, pada hari Jumaat. Ketika ditanya, Wan Kadri berkata beliau tidak mengenali wanita berkenaan dan hanya sempat menyapa semasa menaiki pesawat. Beliau dan yang lainnya seterusnya melakukan penerbangan ke bandar Rompin, bandar Muadzam Shah dan berpatah balik ke Kuantan. Pada hari Sabtu, Wan Kadri berkata, beliau pada mulanya berkereta dengan Jamaluddin dari Kuantan ke Pekan untuk menyertai satu program bersama bekas menteri itu. Mereka berdua seterusnya menghadiri majlis perkahwinan anak perdana menteri di Taman Tasik Sultan Abu Bakar di bandar diraja itu. Kemudiannya, mereka menaiki helikopter itu semula di Rompin bersama lima penumpang dan juruterbang yang sama untuk perjalanan menuju ke Muadzam Shah. Menurutnya, Jamaluddin berhasrat untuk menziarahi keluarga seorang kenalan yang baru meninggal dunia pada hari itu di Muadzam Shah. Namun, disebabkan keadaan cuaca buruk, helikopter itu tidak dapat meneruskan perjalanan ke Muadzam Shah, katanya. Tambahnya, beliau seterusnya memutuskan untuk turun di Kota Bahagia untuk pulang ke rumahnya. Pesawat itu kemudiannya meneruskan perjalanan ke Kuala Lumpur, dan itulah kali terakhir beliau melihat rakan lamanya itu. "Selepas itu helikopter itu terhempas," kata Wan Kadri yang mula mendapat tahu mengetahui mengenai kejadian malang yang menimpa pesawat tersebut apabila dihubungi rakannya selepas itu. Menurutnya, kenalannya itu berkata, helikopter tersebut tidak sampai di Kuala Lumpur. Selepas itu beliau cuba menghubungi Jamaluddin serta penumpang lain namun tidak berjaya. Beliau seterusnya menghubungi pegawai yang bertugas untuk menjemput Jamaluddin di lapangan terbang. Hatinya luluh apabila pegawai tersebut mengesahkan bahawa helikopter berkenaan terhempas. "Saya tak terkata, saya masih terkejut, sampai hari ini, makin lama makin rasa kehilangan sebab saya dengan dia baik sangat. "Saya sedih dan rasa tertekan dengan apa yang terjadi," katanya dengan nada sayu. Pesan bina pusat tahfiz Menurutnya, Jamaluddin tidak menunjukkan sebarang reaksi aneh sebelum kejadian tersebut. Namun, beliau berkata, pesanan terakhir yang ditinggalkan oleh Jamaluddin dua hari sebelum itu masih terpahat di ingatannya. "Dia biasa sangat, dia berborak, ketawa sepanjang pagi, (kami) pergi tengok rumah mak dia, berjogging dan memang tak menunjukkan apa-apa (perbuatan aneh). "Yang saya ingat hanya satu, yang dia (Jamaluddin) sebut pasal (untuk bina) pusat tahfiz, masa itu dia panggil pegawai daerah sekali," katanya. Menurutnya, Jamaluddin bersungguh-sungguh untuk mengusahakan pembinaan pusat tahfiz tersebut "sementara dia masih ada". "Tan Sri cakap begitu dua malam sebelum (dia meninggal), selepas majlis tahlil di Masjid Kampung Pianggu, Rompin," kata Wan Kadri. Jelasnya lagi, Jamaluddin sudah bersedia untuk mewakafkan tanah peribadinya bagi membangunkan sekolah tahfiz berkenaan.
Bimbang Provokasi Melampau Punca Kerajaan Buat 'Pusingan U' Akta Hasutan - Nancy

KUALA LUMPUR:Kebimbangan pelbagai pihak terhadap perbuatan provokasi yang semakin melampau menjadi antara sebab kerajaan membuat 'pusingan u' terhadap Akta Hasutan, kata Menteri di Jabatan Perdana Menteri, Nancy Shukri.
Nancy berkata, dalam tempoh akta tersebut sepatutnya dimansuhkan sebelum ini, beliau didatangi pelbagai pihak termasuk intelektual dan profesional daripada pelbagai kaum yang mahu akta itu dikekalkan demi menjaga keharmonian negara.
"Mereka ini bimbang provokasi terhadap institusi raja, agama, bangsa dan bahasa menjadi sesuatu yang begitu biasa di negara ini apatah lagi melalui media sosial.
"Jadi mereka luahkan kebimbangan itu kerana amat risau akan terjadi pelbagai ketegangan apabila ada pihak yang menghina agama atau bangsa mereka," katanya kepada pemberita di lobi Parlimen di sini, Selasa.
Namun, kata Nancy, beliau tidak mempunyai kuasa untuk memastikan akta tersebut dikekalkan, tetapi kemudian lega apabila Perdana Menteri, Datuk Seri Najib Tun Razak akhirnya mengambil keputusan mengekalkannya dengan beberapa pindaan.
Rang Undang-undang Hasutan (Pindaan) 2015 dibentangkan Menteri Dalam Negeri, Datuk Seri Dr Ahmad Zahid Hamidi untuk bacaan kali pertama di Dewan Rakyat pada Selasa walaupun sebelum ini bercadang untuk memansuhkan akta berkenaan.
Menurut kertas rang undang-undang itu, keputusan meminda akta berkenaan didorong perkembangan politik semasa, termasuk lontaran komen, penyebaran maklumat dan penerbitan yang dikhuatiri memudaratkan keharmonian negara.
Pindaan mengandungi penambahan -langkah dan hukuman yang diperkukuh bagi menangani ancaman terhadap keamanan, ketenteraman dan keselamatan di negara.
Bagaimanapun, Nancy yang juga anggota Parlimen Batang Sadong, berharap pihak yang mempunyai kuasa supaya seboleh mungkin mengelak menggunakan akta itu.
"Saya yakin kerajaan juga tidak mahu sewenang-wenangnya menggunakan akta ini, tetapi saya berpendapat ia patut 'disimpan' kerana supaya jika terjadi hal-hal membabitkan provokasi tidak terkawal, kita ada tempat untuk merujuknya," katanya.
