Council fails to hand over keys to MCA members

Kajang Municipal Council (MPKj) officers failed to return the keys to a building involved in a property tussle despite a letter by MCA members asking them to do so by noon yesterday. Serdang MCA chairman Datuk Liew Yuen Keong, deputy chairman Datuk Hoh Hee Lee and MCA members waited for about 45 minutes before giving their statement to the press. Liew claimed that MPKj's failure to hand over the keys was tantamount to contempt of court. "It shows the council is not sincere in returning the keys to us despite the court's decision. This (seizure of the building) is politically motivated," he said, alleging that the council had been used as a "tool for political gains".
On Friday, the Shah Alam High Court had allowed an injunction applied by MCA secretary-general Datuk Seri Kong Cho Ha to stop the council from locking or entering the building, located at Jalan Indah 1/1, Taman Indah, Batu 11, Cheras. The injunction, which further sought for the council to return seven sets of new keys to the building as well as the items inside that were seized, was allowed pending full hearing of the trial. In a subsequent letter from MCA's lawyers to MPKj, it was stated that the council was to deliver the keys at noon yesterday.
Batu 11 MCA branch chairman Lim Teong Hui said MCA would continue to allow the community to use its premises for activities. "The electricity and water bills will be paid by MCA and we will allow the community to use it free of charge. They only need to pay for the classes they attend," he said. Liew said MCA lawyers later contacted those representing the council, who promised "to deal with the matter in a few days' time."
When contacted, Lim Lip Eng, the lawyer representing MPKj, said the date and time to return the keys and seized items were not stated in the injunction. "I received the letter on Friday," he said. "However, in the injunction, it is only stated that the council has to return the items within the time set by the court. "We will wait for the court's decision and for the MCA lawyers to inform us of the time and date.
"We will abide by the law," he said.
Council corporate communications head Shariman Mohd Nor said he would check with his officers on the matter.

மலேசிய மருத்துவமனைகளில் பிறந்தும் குடியுரிமை பெறுவதில் அவதிப்படுகின்றனர் நமது இந்திய சமூகத்தினர்.  இப்பிரச்னையில் 40,000 இந்தியர்கள் சிக்கிக் கொண்டிருக்கின்றனர் என்பது வேதனைக்குரியதே என்று கிள்ளான் நாடாளுமன்ற உறுப்பினர் சார்ல்ஸ் சந்தியாகோ கூறினார்.

"19 பிப்ரவரி முதல் 26 பிப்ரவரி வரை நடைபெற்ற மை டஃப்தார் பதிவில் மொத்தம் 6,541 இந்தியர்கள் பதிந்துள்ளதாக நாடாளுமன்றத்தில் நான் எழுப்பிய கேள்விக்கு அமைச்சர் தகவல் அளித்திருந்தார்."

பிறகு மை டஃப்தார் பதிவின் வழி 1,000 இந்தியர்களுக்கு அடையாளப் பத்திரங்கள் மிக விரைவில் கிடைக்கும் என அறிவித்திருந்தார் மனிதவள அமைச்சர் டாக்டர் எஸ்.சுப்ரமணியம்.

ஆனால் மாதங்கள் பல கடந்தும் இந்தியர்களின் குடியுரிமை பிரச்னை இதுவரையில் தீர்க்கப்படவில்லை. இதுவரை எவருக்கும் குடியுரிமை வழங்கப்படாதது ஏன் எனக் கேள்வி எழுப்பிய சார்ல்ஸ், இந்தியர்களின் அடிப்படை பிரச்னைகளைத் தீர்ப்பதில் ஏன் அரசாங்கம் மெத்தனப் போக்கை கடைப்பிடித்து வருகிறது என்று மேலும் வினவினார்.

"தற்போது அரசாங்கம் சட்டவிரோத அந்நிய தொழிலாளர்களைப் பதிவு செய்வதில் ஆர்வம் காட்டி வருகின்றது. குறுகிய காலத்திலேயே 1.5 மில்லியன் அந்நிய தொழிலார்களைப் பதிவு செய்துள்ள அரசாங்கம், மலேசியாவில் பிறந்த  இந்தியர்களின் குடியுரிமை பிரச்னையைத்  தீர்க்க மட்டும் ஏன் ஆண்டாண்டு காலமாக இழுத்துக்கடித்துக் கொண்டிருக்கிறது?"

ஒருவருக்கு நான்கு மணி நேரம், இந்தியருக்கு 40 ஆண்டு காலம்

நிரந்தர வசிப்பிடத் தகுதி கொண்ட மிஸ்மாவிற்கு  நான்கே மணிநேரத்தில் குடியுரிமை வழங்கபட்டது! ஆனால், இந்தியர்கள் முறையான ஆவணங்கள் வைத்திருந்தும் குடியுரிமை பெறுவதற்காக 30-40 ஆண்டுவரையில் காத்திருக்க வேண்டியுள்ளது.

"இந்தச் சூழ்நிலை மாற வேண்டும். அதற்கு மனிதவள அமைச்சும் அரசாங்கமும்  களம் இறங்க வேண்டும். இந்தியர்களின் அடிப்படை பிரச்னைகளுக்கு உடனடி தீர்க்கப்பட வேண்டும். குடியுரிமை ஒவ்வொரு மனிதனின் உரிமை. மலேசியாவில் பிறந்த ஒவ்வொருவருக்கும்  குடியுரிமை பெறும் உரிமை உள்ளது" என்பதை விளக்கிய சார்ல்ஸ், இந்தியர்களின்  உரிமையும் காக்கப்பட வேண்டும் என்றார்.

Tajuddin Bailout: Did Nazri Finish Law School?

I have asked earlier for the Minister in the Prime Minister's Department, Datuk Seri Nazri Aziz to be investigated under Section 2(1) of the Emergency (Essential Powers) Ordinance No. 22/1970 where "Any member of the Administration, Parliament or State Legislative Assembly or any public officer who commits a corrupt practice shall be liable to a term of imprisonment of 14 years or a fine of RM 20,000 or both."

A "corrupt practice" in this case is defined as "any act done by a member... in his capacity as such member... whereby he has used his public position or office for his pecuniary or other advantage..."

When questioned on the above, Nazri retorted that I was "practising double standards".

Nazri told The Malaysian Insider, "I want to ask him (Pua): When (PAS president Datuk Seri Abdul) Hadi Awang asked the Damansara Utama Methodist Church (DUMC) and Jais (Selangor Islamic Religious Department) to see him and explain the recent church raid, why did he not rebuke Hadi? Because what power does Hadi have in doing so? He is not the mentri besar of Selangor and neither is he the minister for religious affairs. So why the double standards, Tony?"

I'm complete shocked by the absurdity of the analogy used to accuse me of being hypocritical and practising double standards.

Firstly, PAS President Datuk Seri Abdul Hadi Awang did not ask DUMC and JAIS to see him. Hadi asked to see them to better understand the recent controversy at DUMC.

Secondly, PAS President did not give any directive to JAIS, a government body – whether to withdraw from investigation the alleged offences or to take action against any party.

Thirdly, even if Hadi did in effect express an opinion on the issue, one way or another, it does not constitute a directive especially since Hadi is not a "member of the Administration" who is able to exercise the powers of his public office over JAIS.

On the other hand, Nazri as a Minister is clearly a "member of the Administration" who has "used his public position or office" to unduly exercise improper influence over the actions of Government Linked Companies (GLCs) by-passing the GLCs Board of Directors, possibly to obtain "pecuniary or other advantage…"

It is the exact same law used to find Datuk Seri Anwar Ibrahim guilty of alleged abuse of power in 1999 where he was sentenced to jail for 6 years. Anwar, while holding the post of Deputy Prime Minister and Minister of Finance, was found guilty of having "committed corrupt practice" by giving alleged directives to two police officers.

If there is a relevant analogy at all, it has to be with the former Deputy Prime Minister's case. The comparison between his actions and that of the PAS President is that between night and day, which raises the question of whether Nazri is qualified to take on the role of Minister in-charge of law.
